According to authorities, a 27-year-old woman died at Jacobi Hospital after being rear-ended on Jan. 1. The collision occurred when the driver of a Dodge Charger struck a Mercury Marquis livery cab around 8:15 a.m.; the woman was sitting in the back seat of the Mercury at the time of impact. The incident took place at the Cross Bronx Expressway and Rosendale Avenue intersection when the cab was stopped at a red light. The 54-year-old driver of the Mercury was transported to Einstein Hospital and reported to be considered stable.

Police alleged that the driver of the Dodge was drunk when he struck the other vehicle. Witnesses said that the crash was so severe it completely smashed in the trunk of the Mercury, and the cab driver said that he was knocked unconscious when he was rear-ended.

The 37-year-old Dodge driver and his 29-year-old passenger were treated for minor injuries at the same hospital the woman was taken to. Police charged the driver with operating a motor vehicle while intoxicated, criminally negligent homicide and vehicle manslaughter.

In cases like this where criminal charges have already been brought against a negligent driver, it is possible that the family members of the woman who was fatally wounded may choose to hire an attorney to recover medical bills incurred before death and loss of companionship. When an attorney seeks to establish that negligence was a factor in car accident, he or she may be able to use the completed police report and eyewitness accounts to prove that the accident could have been avoided and that the driver is responsible to compensate the other parties for the wrongful death.
