A bicycle is never a match for a truck as was proven after a recent accident in upstate New York. A boy on a bicycle was struck by a pickup truck. The 12-year-old lost his life as a result of the tragic car accident.
The accident happened on a Friday afternoon as the boy was riding his bike along a county highway. He was transported to the hospital with what was reported to be life-threatening injuries after being struck by the pickup. Despite efforts and medical care at a nearby facility, the child died from the injuries that night.
The driver of the truck was not injured in the incident and was reported to be the only person occupying that vehicle. An investigation into the car accident by the county sheriff’s department is in progress. As of yet, there have been no criminal charges filed against the person who hit the boy in the incident.
Understandably, a car accident that takes the life of a young child is devastating for a New York family in an untold number of ways. The family of this young victim may have legal recourse in the form of a wrongful death lawsuit against the driver of the vehicle and any separate party with an ownership interest in the pickup truck. If successful presented in a New York civil court, a wrongful death claim can result in an award of monetary damages that can prove useful as a family deals with the financial impact of an unexpected and tragic car accident of this nature.
