Woman arrested after fatal pedestrian accident

In our state, it is a crime to leave the scene of an accident where one or more parties suffered injuries. Police say that a 57-year-old woman recently caused a fatal pedestrian accident in New York and attempted to leave the scene. She has been arrested and charged with leaving the scene of an accident that resulted in death.

Around 8:30 p.m. in Deer Park, the woman was traveling north in her SUV. A woman who has not yet been identified was attempting to cross the street when she was struck by the SUV. According to witnesses at the scene, the driver initially stopped after the impact, but she decided to flee the scene before the emergency responders arrived.

The witnesses were able to provide the responding police officers with a description of the SUV. An officer who was on patrol nearby claims that he spotted an SUV matching the witness’ descriptions, and he proceeded to pull the vehicle over and question the driver. The officer ultimately arrested the driver, and her SUV was impounded due to the ongoing investigation of the accident.

Depending on the investigation, the woman may eventually face additional criminal charges relating to the fatal pedestrian accident. Additionally, once the victim is identified, the surviving family may elect to take separate legal action against the driver. A New York wrongful death suit against the driver may be commenced, seeking monetary relief for damages due to her alleged negligent behavior. To prevail, the family would need to prove by appropriate evidence that the victim’s death was caused by the negligent or reckless conduct of the driver.
